Terms of Use
These terms govern intellectualcapitalsystems.com and anything you download from it. Using the site means you accept them. If you have signed a Master Services Agreement with us, that agreement governs our work for you and these terms do not narrow it.
What we publish
The whitepaper, the notes and everything else on this site are published to be useful and to show how we think. They are not professional advice — not legal, financial, medical, or advice about your specific situation — and reading them creates no consulting relationship. We take on work only under a signed Statement of Work.
The software
The vault kit plugin and the Anonymizer are provided free, as is and without warranty of any kind, express or implied, including any warranty of merchantability, fitness for a particular purpose, or non-infringement. Each is released under the licence in its repository and that licence governs your use of it.
About the Anonymizer specifically. It proposes redactions for a human to review. Identifier detection is probabilistic and its measured recall is published in the repository. It does not guarantee that a document has been de-identified, and it does not perform HIPAA de-identification under either the Safe Harbor method or expert determination. Do not rely on it as a compliance control. Read docs/threat-model.md before you use it on anything that matters.
To the maximum extent the law allows, we are not liable for any indirect, incidental, consequential or special damages arising from the site or the free downloads, and our total liability for anything on this page will not exceed [USD 100 / the amount you paid us, which for these downloads is nothing].
What is ours
The site, the whitepaper and our templates and methods are our intellectual property. Read them, quote them with attribution, send them to a colleague. Do not republish them as your own or resell them.
Links out
We link to other people's material. We do not control it and we are not responsible for it.
Governing law
Massachusetts, without regard to its conflict-of-laws rules. Any dispute goes to the state or federal courts sitting in [Suffolk/Middlesex] County, Massachusetts.
Changes
We may update these terms. The date above tells you when we last did.
